Terms of Use

Welcome to Figuritas App (the "App"). By using the App, you agree to be bound by these Terms of Use ("Agreement"). Please read these terms carefully before using the App. If you do not agree to be bound by all the terms and conditions of this Agreement, you may not use the App.
 

1. Use of the App. The App is designed to help users collect and trade stickers. You may use the App only for lawful purposes and in accordance with this Agreement. You agree not to use the App:

   • a. In any way that violates any applicable federal, state, local or international law or regulation;

   • b. For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise;

   • c. To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation;

   • d. To impersonate or attempt to impersonate Figuritas App, a Figuritas App employee, another user or any other person or entity; e. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App, or which, as determined by Figuritas App, may harm Figuritas App or users of the App or expose them to liability.

2. Account Registration. To use certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. Figuritas App shall not be liable for any loss or damage arising from your failure to comply with this obligation.

3. Acceptance of Emails. By signing up for an account with Figuritas App, you agree to receive occasional emails from Figuritas App. These emails may contain promotional or informational content related to the App or its partners. You may opt-out of these emails at any time by following the unsubscribe link in the email.

4. Intellectual Property. The App and its entire contents, features, and functionality are owned by Figuritas App and its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Disclaimer of Warranties. The App is provided "as is" and Figuritas App makes no representations or warranties of any kind, whether express, implied, statutory or otherwise with respect to the App or any content or services available through the App, including any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement.

6. Limitation of Liability. In no event shall Figuritas App, its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the App, whether based on contract, tort, strict liability, or otherwise.

7. Indemnification. You agree to indemnify, defend, and hold harmless Figuritas App, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Agreement or your use of the App.

8. Governing Law. This Agreement and any dispute arising out of or in connection with this Agreement or the App shall be governed by and construed in accordance with the laws of Uruguay, without giving effect to any choice or conflict of law provision or rule.

9. Dispute Resolution. Any dispute arising out of or in connection with this Agreement or the App shall be resolved by binding arbitration in accordance with the Uruguay laws. The arbitration shall take place in Montevideo, Uruguay. The award rendered by the arbitrator(s) shall be final and binding on both parties, and judgment may be entered in any court having jurisdiction thereof.

10. Entire Agreement. This Agreement constitutes the entire agreement between you and Figuritas App regarding the use of the App and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Figuritas App.

11. Modifications. Figuritas App may modify this Agreement from time to time, in its sole discretion, by posting a revised version on the App or by providing notice to you. Your continued use of the App following any such modification constitutes your acceptance of the revised Agreement.

12. Termination. Figuritas App may terminate your access to all or any part of the App at any time, with or without cause, with or without notice, effective immediately.

13. Miscellaneous. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Figuritas App's failure to enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Figuritas App in writing. This Agreement does not create any agency, partnership, joint venture, or employment relationship, and you may not make any representations on behalf of or bind Figuritas App in any manner.

14. Additional Terms for Apple Users. Certain features or services provided by Figuritas App may be subject to additional terms and conditions specifically for Apple users. By using such features or services on an Apple device, you agree to be bound by the additional terms and conditions, which are available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. All terms and conditions contained in the link are hereby incorporated by reference into this Agreement solely for Apple users. In the event of any conflict between such additional terms and this Agreement, the additional terms will govern for those specific features or services used on an Apple device.
